We do trademark registration in Iraq and in the Kurdistan Region in accordance with the Iraqi law
Iraq is one of the Member Countries in Paris covenant. According to the Iraq trademarks law (trademarks and commercial data no.21 in 1957).
The trademark has been arranged. And according to the (coalition provisional authority). The law has been amended No. 80 law (April 26, 2004).
According to the Iraq trademarks law the trademark is: a sign or combination of signs that used by person to define and differentiate person service. Including the (unique services) from other services.
The owner of the trademark has all the legal rights. The trademark is considered as a property of the person who registered it and it cannot be disputed in ownership. Only if (the owner did use it for 5 years from the registration date).
Legal entities or individuals Iraqi’s or foreigner can register trademarks in Iraq. The trademark owner is the only person that prevents to use the trademark from other person in Iraq.
The trademarks can registered in Iraq for 10 years and after this period the owner should renew the trademark.
According to the law of trademarks in Iraq every person who own famous prerogative trademark have the right to protect his trademarks in Iraq even though it wasn’t registered.
